Under the Points Based System UK employers have to be licensed by UK Visa and Immigration (UKVI) before they can employ non-EEA workers. Sponsor licences are granted for an initial period of four years and those companies which are completing the four-year sponsor cycle and who wish to continue employing migrant workers are now required to renew their licence.

What do employers have to do?

Companies have to submit a sponsor licence renewal application via the online Sponsor Management System. The UKVI advises that renewal applications can be submitted at least three months prior to the current licence expiry date, and a nominated Level 1 User should be able to pay an appropriate fee, complete a sponsor declaration and request renewal online.

As part of the sponsor licence renewal process, the UKVI reserves a right to undertake a compliance visit to sponsor companies and request corporate documentation as deemed necessary.

Your organisation should undertake proactive steps to ensure readiness for this process:

  • ensure that your organisation continues meeting sponsorship duties, including maintenance of records for migrant workers, carrying out necessary compliance checks on your staff and timely reporting migrant activities to UKVI;
  • make necessary changes to your sponsor licence before an extension application is lodged with the UKVI; and
  • ensure that licence management to date has been compliant and that the application for renewal is accurate, timely and effective.

Sponsor Licence Renewal Fee

Under the Points Based System UK employers have to be licensed by UK Visa and Immigration (UKVI) before they can employ non-EEA workers. Employers who do not have a sponsor licence will be unable to hire new workers from outside the EU or extend work permits for current employees.

What do employers have to do?

To apply for a licence companies must prove that:

  • They are a genuine organisation operating lawfully in the UK.
  • Their Key Personnel named on the application are honest, dependable and reliable
  • They are aware of and capable of carrying out their sponsor duties ie they have appropriate human resources and recruitment systems and practices in place
  • They are offering genuine employment that meets the Tier 2 (General) skill level and appropriate rates of pay.

 

Companies must complete an online application and provide supporting documentation to meet the necessary evidentiary requirements. This must be supplied within five days of the initial application.

Failure to submit all required documents will result in an application being delayed or rejected and further costs being incurred.

Following the receipt of these documents, the company may then be subject to a compliance visit from UK Visas and Immigration, who will assess whether or not to grant the licence.

Companies will also be required to comply with the illegal working requirements which states that all non-EU employees are required to provide documentation that proves their right to work BEFORE being employed by a UK company and copies of this information must also be retained by the employer.

What is the Sponsor Licence Renewal Fee?

The fee is payable when your application is submitted and the charge will vary depending on the size and turnover of your organisation, with a discounted rate for Charities and small organisations. It is essential that you pay the correct fee or your renewal application will be rejected.

UKVI apply the Companies Act 2006 classification to determine whether a business is small, medium or large.
